New Airport Wins in Federal Court

The local airport authority’s winning streak in federal court continued Thursday as an Atlanta appeals court refused to halt work on a new airport at West Bay.

Earlier this month, Jacksonville Federal Judge Tim Corrigan said "no" when several environmental groups wanted an injunction stopping work on the new airport until their lawsuit is decided.

They had challenged the Army Corps of Engineers issuance of a “404 Permit” for the new airport. After Judge Corrigan made his ruling, the Natural Resources Defense Council and other environmental groups had filed an appeal with the 11th Circuit Court of Appeals in Atlanta. Thursday, a three judge panel also said "no" to the injunction request.

Last month, a Federal Appeals Court in New York City refused to stop work on the new
330 million dollar airport facility.
